ACB Produces Charge sheet Against Mohd. Sarwar Dar, the then Executive Engineer, Khazir Khanday, the then AEE, Irrigation and Flood Control and others in Court of Anti Corruption Judge Baramulla



Anti-Corruption Bureau produced Charge Sheet before the Hon’ble Court of Special Judge Anti-Corruption Baramulla in Case FIR No. 20/2014 of P/S VOK (now ACB) under Section 5(1) (c)(d) r/w 5(2) P.C Act 2006, Section 120-B, RPC against the following officers/officials/beneficiary of Irrigation and Flood Control Division Handwara:-
a) Mohammad Sarwar Dar, the then Executive Engineer Irrigation and Flood Control Division Handwara
b) Khazir Mohd Khanday, the then AEE Irrigation and Flood Control Division Handwara.
c) Gh. Mohi-ud-din Peer the then JE, Irrigation and Flood Control Division Handwara.
d) Abdul Aziz Kumar the then Head Draftsman Irrigation and Flood Control Division Handwara.
e) Akhtar Mohi-ud-din Baba the then Draftsman Irrigation and Flood Control Division Handwara.
f) Irfan Ahmad Bhat the then Draftsman Irrigation and Flood Control Division Handwara.
g) Nazir Ahmad Mir(Beneficiary Contractor).
2. The brief facts of the case are that the instant case stands registered in Police Station Vigilance Organization Kashmir (now ACB) on the outcome of the verification conducted into the allegations that the officers/officials of Irrigation and Flood Control Division Kupwara Headquarter Handwara in connivance with contractors have embezzled/misappropriated huge amount of Government money in the year 2008-09 & 2009-10 during execution of various works.

During the course of enquiry, it come to fore that the work viz “Increasing capacity by way of deepening and widening of Dharamwari Storage tank” was allotted to one Nazir Ahmad Mir for an allotted cost of Rs. 18.265 lacs. The work was extended which inflated the allotted cost to Rs.19.949 lacs. During inspection, measurements were found lesser to the recorded and paid ones. The overall measurement of shortage was found 55 mts.

4. Moreover, the quantity of earth work charged by the department was found contrary to the actual quantity. The actual quantity of earth work was found executed only 5,926 cubic mts instead of 14,091 cubic Mts, thereby causing a loss of an amount of Rs.11,55,906/- to the State Exchequer by way of misappropriation.

5. The Investigation of the case was concluded as proved against the aforementioned accused public servants and contractor for launching prosecution.

6. The Chargesheet of the case has been produced before the Hon’ble Court of Special Judge Anti-corruption, Baramulla Kashmir.
