ACB registers case against Ravinder Singh Jamwal the then Joint Commissioner, Jugal Kishore, the then Enforcement Inspector JMC Jammu and others for issuing building permission for construction of PR Hotel at Bakshi Nagar in contravention of rules.

Anti Corruption Bureau registered Case FIR No. 03/2021 upon a complaint alleging therein the running of PR Hotel at Bakshi Nagar without permission as well as valid documents etc.

2. The verification conducted revealed that two building permissions were obtained by Smt. Puja Gupta W/o Rahul Gupta and Rahul Gupta S/oPremSagar Gupta R/o Qtr. No. 186, Roulki, Bakshi Nagar Jammu separately during 2014. After processing of files, the Jammu Municipal Corporation issued building permission to Puja Gupta vide building permission No. 440/BS/2014 dated 15.09.2014.Similarly, building permission No. 461/BS/2014 dated 18.09.2014 was issued to Rahul Gupta with dimensions :-
“The said Puja Gupta and Rahul Gupta who are husband and wife constructed a huge Hotel PR at Bakshi Nagar Jammu against two separate building permissions over the site in violation to building permissions as well as Municipal by laws / rules.”

3. The probe conducted revealed that Khilafwarzi section of the Jammu Municipal Corporation was hand in glove with the beneficiaries who aided in the said illegal construction thereof. The JMC issued notices U/S 7(1) of BOCA Act to both the beneficiaries and thereafter Notices U/S 7(3) of COBA Act were also issued which facilitated the violators to get the violations compounded through Special Tribunal. All the violations which were in fact major in nature stand regularized at a very meager amount of Rs. 20/- per sft. The Jammu Municipal Corporation did not take much time and accepted the fine of Rs. 1,62,802/- on account of violations and regularized the Hotel. Not only this, the beneficiaries again carried on the illegal construction at 3rd floor of the said PR Hotel and Khilafwarzi Inspector of the Area instead of stopping the illegal construction only reported the matter on 08.10.2015 and 12.10.2015. The violations were again challenged before Special Tribunal on 02.11.2015 which stands compounded/regularized on 03.03.2016 but this time, the Commissioner JMC did not implement the order of Special Tribunal and filed an appeal in the Hon’ble High Court where the matter is still pending.

As per enquiry conducted, the illegal construction was never stopped by Jammu Municipal Corporation at any point of time till the huge construction of the PR Hotel was completed by violating the front setback of 50’-0’’ which comes on the main road of Bakshi Nagar, besides 100% violation of building permissions as well as Municipal by-laws. The then Enforcement Inspector Jugal Kishore & then Joint Commissioner, JMC Jammu Ravinder Singh Jamwal, by abuse of their official positions and in connivance with beneficiaries and others, aided and facilitated the illegal construction of PR Hotel at Bakshi Nagar Jammu, just to confer undue benefit to the owners of PR Hotel. The aforesaid acts of omission and commission on the part of public servants namely Jugal Kishore S/O Sh. GopalDass R/O Q No. 108 Rehari Colony, Jammu, then Enforcement Inspector, Ravinder Singh Jamwal S/O Late Sh. Ajmeer Singh R/O Q. No. 10, Municipal Quarters, Gandhi Nagar, Jammu, then Joint Commissioner, JMC Jammu, beneficiaries namely Puja Gupta W/O Rahul Gupta and Rahul Gupta S/O PremSagar Gupta R/O Qtr. No. 186, Roulki, Bakshi Nagar Jammu and others constitute offences punishable under section 5 (1) (d) r/w 5 (2) J&K P.C. Act. Svt. 2006 and section 120-B RPC.

5. Further investigation of the case is going on.
