Anti-Corruption Bureau J&K registered two cases in Kashmir and also produced Charge Sheet in Hon’ble court of Special Judge Anti-Corruption Doda in case FIR No.43/2017



1. ZEO and Accountant (Sr. Assistant) in Anti Corruption Bureau net

On the basis of a written complaint lodged by Shri Gh. Mohammad Wani S/o Ab. Gani Wani R/o Naroopora Kukarnag Anantnag alleging therein that ZEO Qazigund namely Shri Imtiyaz Ahmad Hakeem was approached by him for release of payment for two executed works viz Construction of Boundary wall of Middle School Wanpora Kewa and BRC Qazigund which he delayed for long and finally demanded bribe of Rs.5000/- from the complainant. It was further alleged that payment for BRC Qazigund was released by the ZEO on 17 January 2019 after receiving the bribe amount of Rs.5000/- from the complainant while the other payment was still kept withheld. Moreover when the complainant asked the ZEO to release the second payment of Wanpora Kewa Middle School Boundary Wall, the ZEO demanded further amount of Rs.5000 and asked the complainant to keep the money with his clerk/Acctt, Sulinder Singh in ZEO office so that after receiving the money he will release the payment of the second work. However, before paying the said amount to the accused ZEO, through the clerk/Acctt, the complainant who was against paying bribe, brought Rs.5000/- along with the written complaint to the Anticorruption Bureau for taking legal action against the accused public servants under law.

The trap team constituted by ACB Kashmir headed by Dy. SP Mohammad Shafiq laid a successful trap in which Shri Sulinder Singh a Clerk ZEO Office Qazigund was caught red handed while demanding and accepting bribe amounting Rs.5000/- from the complainant. The tainted money was recovered from the possession of the accused in presence of independent witness.

A case FIR No. 03/ 2019 P/S ACB Kashmir has been registered in Anti Corruption Bureau, Kashmir under section 5(1) (d) r/w 5(2) J&K P.C. Act Samvat 2006 and Sec 4-A of the amended PC Act against the above mentioned accused public servant. Later on the relevant records were seized and both the Clerk (Sr Asst/ Accountant) along with the accused ZEO were arrested for the commission of corrupt practices. Further investigations are going on, into the case.



2. Case FIR No.04/2019 registered against officers / officials of SMC.



On the outcome of verification conducted by Anti-Corruption Bureau Kashmir it has surfaced that SMC Srinagar have issued building permission No. 267 of 2009 dated 03-09-2009 in the name of one Ghulam Qadir Sofi who had already expired on 14-06-2008 and the son of the deceased namely Mohammad Arif Sofi R/o P.C Depot Rehmat Abad Qamerwari Srinagar in lieu of said building permission and under well knit conspiracy with officers/officials of SMC Srinagar, namely 1). Ab. Salam then Ward Officer ( now Rtd.) 2). Gh. Rasool Dar, then Ward officer 3). Mohammd Yousuf then Building Inspector constructed two commercial structures in clear violation to the norms and sketch of building permission which was otherwise for residential purpose.

In this way the above mentioned officers/officials of SMC by sheer abuse of their official positions conferred undue benefit upon themselves and the beneficiary deliberately with ulterior motives.

The above mentioned omission and commission on the part of officers/officials of SMC Srinagar and the beneficiary disclose offences punishable U/S 5(1) (d) read with section 5(2) J&K PC Act Svt 2006 and Section 120-B accordingly Case FIR No.04/2019 is registered in P/S ACB Srinagar and further investigation into the case is on.



3. ANTI-CORRUPTION BUREAU JAMMU PRODUCES CHALLAN AGAINST CA&PD OFFICIALS IN GRAFT CASE.



Today on 19-01-2019 Anti-corruption Bureau Jammu has produced Challan against accused Officials of CA&PD Department namely Sh.Nazir Ahmed Wani the then TSO RambanS/O Late Lassajoo Wani R/O Chareel Tehsil Banhil District Ramban and Sh.Farooq Ahmed Mir then Storekeeper S/O Sh.Abdul Gani Mir R/O Bankot Tehsil Banihal District Ramban at present Kundi Karol District Ramban before the Hon’ble court of Special Judge Anti-Corruption Doda in case FIR No.43/2017 P/S ACB Jammu U/S 5 (1) (d) read with section 5 (2) J&K P.C. Act Svt. 2006 and Sec.4-A PC Act (Amendment 2014) and 120-B/RPC. Brief facts of the case are that on 30-11-2017 a complaint was lodged by one Munshi Ram S/O Shri Suram Chand R/O Harogh Tehsil & District Ramban in Vigilance Organization Jammu (now Anti-Corruption Bureau) alleging therein that the complainant is working as ration dealer in CA&PD Food Store Harogh Tehsil Ramban for last 32 years but is being harassed by TSO Ramban namely Nazir Ahmed every time during the disbursement of carriage charges and he is demanding bribe from him. The Complainant further alleged that for the month of November 2017 approximately an amount of Rs.1.50 lacs on account of carriage charges was transferred by the said TSO into the account of complainant, out of which Rs.10000/- were paid by him to the said TSO as bribe but the TSO is further demanding Rs.90,000/- and has threatened the complainant that if he does not pay the said amount, he will cancel his ration license. Finally the amount of bribe was settled at Rs.50000/- out of which Rs.10000/- were already paid by the complainant to the said TSO while as the remaining amount of Rs.40000/- was to be paid to the said TSO on 30.11.2017. However, the complainant this time preferred to file a complaint in P/s VOJ (now ACB) requesting therein for taking legal action against the corrupt CA&PD official under law. On receipt of the said complaint, a formal case under the relevant sections of law was registered in P/S VOJ (now ACB) and investigation taken-up. During the investigation, a successful trap was laid into the instant case and during the trap Farooq Ahmed Mir (Storekeeper) Food Store Ramban was caught red handed by the sleuths of Vigilance (now ACB) while demanding and accepting Rs.40,000/- from the complainant in the presence of independent witnesses on the behalf of accused Nazir Ahmed Wani TSO. During search the tainted bribe amount of Rs.40,000/- was recovered from the possession of accused Farooq Ahmed Mir Storekeeper and he was arrested in the instant case. During the investigation it was found that accused Nazir Ahmed Wani TSO and accused Farooq Ahmed Mir Storekeeper in criminal conspiracy with each other and by abusing their official positions had demanded and accepted illegal gratification from the complainant. After completion of investigation, the case was processed for obtaining necessary Government sanction as envisaged U/S 6 of J&K P.C Act.Svt.2006, in respect of accused public servants. After obtaining the sanction from the competent authority the Challan of the case against the above named CA&PD officials has been produced in the competent trial Court for their judicial determination. Next date of hearing in the case has been fixed for 11.02.2019.
