ACB Produces charge-sheet against the then Executive Engineers of PHE Division Baramulla, PHE Division Tangmarg, FBI Division Tangmarg and others in fake appointments case

Anti-Corruption Bureau produced charge-sheet before the Hon’ble Court of Special Judge Anti-Corruption Baramulla in Case FIR No. 11/2010 of Police Station VOK (now ACB) under Section 5(2) of Jammu & Kashmir Prevention of Corruption Act, Samvat 2006 r/w Section 420, 467, 468, 471,120-B RPC against the following officers/officials/beneficiaries:-
i. Syed Mohd. Amin Shah the then Executive Engineer, PHE Division Baramulla
ii. Ghulam Mohammad Dar, the then Executive Engineer, PHE Division Baramulla
iii. Abdul Samad Waza, the then Executive Engineer, PHE Division Baramulla
iv. Ghulam Nabi Sheikh, the then Executive Engineer, PHE Division Baramulla
v. Ghulam Qadir Bhat, the then Executive Engineer PHE Division Tangmarg
vi. Ghulam Mohiudin Rather, the then Executive Engineer, PHE Division Baramulla
vii. Mohammad Amin Rather, the then Executive Engineer, PHE Division Tangmarg
viii. Ghulam Hassan Ganaie, the then Executive Engineer, FBI Division Tangmarg
ix. Syed Ali Shah, the then Senior Assistant, FBI Division Tangmarg;
x. Abdul Rashid Rather, the then Bill Clerk, FBI Division Tangmarg;
xi. Mohammad Amin Rather, the then Bill Clerk, FBI Division Tangmarg;
xii. Farooq Ahmad Wani, the then Bill Clerk FBI Division Tangmarg;
xiii. Ghulam Nabi Malla, the then Head Assistant, FBI Division Tangmarg;
xiv. Khazir Mohammad War, the then Junior Assistant PHE Baramulla;
xv. Mohammad Shafi Bolaki, the then AAO, PHE Division Baramulla;
xvi. Rajinder Singh, the then Fitter PHE Division Baramulla;
xvii. Nazir Ahmad Ganaie, the then Junior Assistant, PHE Baramulla;
xviii. Hafizullah Mir, the then Khalasi PHE Division Baramulla;
xix. Zahoor Ahmad Bhat, (Accused beneficiary);
xx. Manzoor Ahmad Malik , (Accused beneficiary);

2- The brief facts of the case are that Syed Mohd Amin Shah the then Executive Engineer, PHE Division Baramulla has forwarded the basic daily wagers list to the then Chief Engineer PHE, Kashmir, wherein, the said accused beneficiaries were not figuring and has initiated the service books of the illegal beneficiaries at a later stage after a gap of 12 years and this has become the basis for the illegal beneficiaries to get themselves adjusted/regularized as Helpers in the department. Ghulam Mohammad Dar, the then Executive Engineer, PHE Division Baramulla has authenticated the services of the accused beneficiaries i.e Shri Manzoor Ahmad Malik & Shri Zahoor Ahmad Bhat at the later stage when he was not holding the chair of Executive Engineer PHE, Division Baramulla. The officer has not verified the service book of the beneficiaries and initial regularization order whereby it could have been ascertained whether the beneficiaries have virtually been regularized by the Govt. vide order No.288 of 1996 or not. Abdul Samad Waza, the then Executive Engineer, PHE Division Baramulla has authenticated the services of the accused beneficiaries i.e Shri Manzoor Ahmad Malik & Shri Zahoor Ahmad Bhat at the later stage when he was not holding the chair of Executive Engineer PHE, Division Baramulla. If the officer would have remained sincere in his dealings, the loss to the state exchequer would have not taken place. Ghulam Nabi Sheikh, the then Executive Engineer, PHE Division Baramulla in connivance with the beneficiaries and other officers/officials of the division has in furtherance of criminal conspiracy authenticated the services of above mentioned beneficiaries without being competent at that time to authenticate the service and also without perusing any basic document in this regard. Ghulam Qadir Bhat, the then Executive Engineer PHE Division Tangmarg has authenticated the services of the accused beneficiaries i.e., Shri Manzoor Ahmad Malik & Shri Zahoor Ahmad Bhat at a stage when they were actually not posted in the said division by appending his signatures afterwards on the service book which he otherwise should have not. Ghulam Mohiudin Rather, the then Executive Engineer, PHE Division Baramulla has authenticated the services of the accused beneficiaries i.e Shri Manzoor Ahmad Malik & Shri Zahoor Ahmad Bhat at the later stage when he was not holding the chair of Executive Engineer PHE, Division Baramulla and has prepared a fake LPCs, relieving orders and service books in connivance with the officials of his division and other division and thus has facilitated the accused beneficiaries to get them regularized in FBI, Division Tangmarg. Mohammad Amin Rather, the then Executive Engineer, PHE Division Tangmarg has allowed one beneficiary namely Manzoor Ahmad Malik to join in reference to a transfer order shown issued by Chief Engineer PHE, Kashmir which does not pertain to the transfer of the said beneficiary. The officer has remained silent over the issue and has facilitated the drawl of salary of the illegal beneficiary without verifying the service book and initial regularization whereby it could have been ascertained whether the beneficiary has virtually been regularized by the Govt. vide order No.288 of 1996 or not. Ghulam Hassan Ganaie, the then Executive Engineer, FBI Division Tangmarg has allowed one beneficiary namely Zahoor Ahmad Bhat to join and has drawn his first salary without verifying the service book and initial regularization order of the beneficiary, whereby it could have been ascertained whether the beneficiary has virtually been regularized by the Govt. vide order No.288 of 1996 or not.
3- The accused public servants have done such illegal act fraudulently and dishonestly with the knowledge that accused beneficiaries were neither working as daily rated casual workers nor were falling within the ambit of government order.
4- The Investigation of the case was concluded as proved against the aforementioned accused public servants for launching prosecution, the charge-sheet of the case has been produced before the Hon’ble Court of Special Judge Anti-corruption, Baramulla Kashmir.
