ACB produces Chargesheet against 03 Government Servants and 04 Private Beneficiaries in CAPD Case of District Kathua



Anti-Corruption Bureau produced chargesheet in case FIR No.14/2012 of P/S VOJ (now ACB-Jammu) U/S 5(1) (c) (d) r/w 5(2) of the Prevention of Corruption Act, Samvat, 2006 and 120-B, 409 RPC against accused government servants namely (a) Amar Singh then TSO Billawar, (b) Jaswant Singh, then Storekeeper CA&PD Store Billawar, (c) Beli Ram, then Salesman, and carriage contractors namely (d) Sukh Ram, (e) Jagdish Raj, (f) Bishan Dass, (g) Khushi Ram for misappropriation of food grains at CA&PD Store Billawar.

2. Brief facts are that case has been registered on the allegations of misappropriation of APL/BPL food grains by way of issuance of food grains in excess to the prescribed quota to far-flung ration depots and preparation of fictitious ration documents by the then TSO CA&PD Department Billawar and others. During investigation, it surfaced that during April 2009 to February 2010, food grains/ration had been received by TSO Billawar from AD CA&PD Kathua for disbursement to different categories of population (under APL, BPL) living in far flung areas of Malhar and Kindli as per prescribed scale while as excess APL/BPL food grains, had been shown dispatched to these Govt. ration depots at Malhar and Kindli for distribution amongst beneficiaries which has actually been misappropriated by above mentioned Government servants then posted in CA&PD Department, Billawar in connivance with private beneficiaries.

3. As per evidence collected during the course of investigation of the instant case, the total loss caused by way of misappropriation of food grains is Rs.23,02,989.07. This amount was in fact the subsidy which was meant for poor public of Malhar and Kindli. was misappropriated by the CA&PD officials for their own benefit, whereas the genuine public was deprived of the subsidy meant for them. Further loss of Rs.4,24,634.44 has been caused by way of excess drawal on account of carriage charges. The loss of Rs.27,27,623.51 has been caused to the state exchequer by the above said accused persons.

4. After completing the investigation of case, sanction for launching of prosecution was also obtained from the competent authority and Anti-Corruption Bureau J&K produced charge sheet against the above mentioned accused persons before the Hon’ble Court of Spl. Judge Anti-Corruption Court Kathua.

5. The next date of hearing has been fixed on 03.02.2020.
